Terms and Conditions of Use

1. Important health notice

Pulsiko offers automatically generated workouts and general exercise recommendations. It is not a medical, nutrition or physical therapy service and does not replace an evaluation by a health professional.

• Consult a doctor before starting any exercise program, especially if you have an illness, injury, heart condition or high blood pressure, are pregnant, or have doubts about your physical condition.
• Stop exercising immediately if you feel pain, dizziness, shortness of breath or discomfort, and seek medical care if needed.
• You are responsible for using proper form, choosing safe weights and checking that your equipment is in good condition.
• You exercise at your own responsibility and risk.

2. Requirements

• You must be 18 or older.
• Provide truthful information and keep it up to date.
• Use one account per person and keep your password secret. You're responsible for activity on your account; if you suspect unauthorized access, change your password and sign out your other devices.

3. Private beta

While Pulsiko is in private beta, access is by invitation from the waitlist, some features may change or fail, and no charges are made. We'll let you know before billing starts.

4. Plans, free trial and payments

• Beta: while Pulsiko is in private beta, full access is free and no charges are made.
• Beta benefits: people who join the waitlist or create an account before launch get, when billing starts, 1 free month and the founder price on the yearly plan, kept as long as the subscription stays active without interruption.
• Free plan: without paying or adding a payment method you can do 1 workout a week and see your full history.
• First workout: your first full workout is free and needs no payment method.
• Paid plans: monthly and yearly. Current prices are published on the pricing page, in US dollars or your country's local currency; applicable taxes are shown before you pay. The yearly launch price is for a limited time and is kept on your renewals as long as you don't cancel.
• Yearly plan trial: 7 days free. To start it you add a payment method (credit or debit card, including virtual cards, or PayPal). We'll email you at least 2 days before the first charge; if you cancel before it ends, you won't be charged. The trial applies once per person.
• Automatic billing: when the trial ends, and at the start of each new period, the chosen plan is charged automatically until you cancel. We'll email you before each yearly renewal.
• Referral program free months: applied as free time before your first charge or on your next renewal.
• Cancellation: cancel anytime from your account, with no commitment or penalty. Cancellation takes effect at the end of the period you already paid and you keep access until then; afterwards you move to the free plan.
• Price changes: we'll notify you at least 30 days in advance; the new price applies from the next renewal and you can cancel before if you don't agree.
• Refunds: you can request a full refund within 14 days after any subscription charge by emailing [email protected]. After that, there are no refunds for partial periods, except where required by law.
• Right of withdrawal: as a distance purchase, you may also withdraw within 5 business days after subscribing, under article 47 of Colombian Law 1480 of 2011 (Consumer Statute). Payment reversal, where applicable, is governed by its article 51.
• Payment processor: payments are processed by Paddle.com, acting as authorized reseller (Merchant of Record): Paddle makes the charge, issues the receipt and handles your country's taxes. By paying you also accept its purchase terms. Pulsiko doesn't store your card data.

5. Referral program

During the beta, when you join the waitlist you get a personal code and link. For every 2 real people who arrive with your link and create their account you earn 1 extra free month (joining the waitlist isn't enough), up to 6 months, added to your free trial once subscriptions are enabled. Fake, duplicate or self-referrals don't count, and Pulsiko may review and cancel rewards obtained abusively. The reward is personal, can't be exchanged for money, and the program may change or end with prior notice, keeping the months already earned.

6. Acceptable use

Pulsiko is for your personal, non-commercial use. You may not:

• Use the service for illegal purposes or to harm others.
• Try to access other users' accounts or data, or parts of the system without authorization.
• Copy, scrape, resell or redistribute the service, its exercises or illustrations.
• Interfere with the operation or security of the service, or use automated programs to access it.
• Upload illegal or offensive content, or photos of other people without their permission.

7. Your content

Your data, photos and records are yours. You give us a limited permission to store and process them solely to provide the service, as explained in the Privacy Policy. You can download or delete them anytime.

8. Intellectual property

The Pulsiko brand, logo, software, exercise illustrations and animations, and texts belong to Skytech Ingeniería S.A.S. or its licensors. We grant you a personal, limited, revocable, non-transferable permission to use them within the service.

9. Availability and changes

We work to keep Pulsiko always available, but there may be interruptions for maintenance or failures. We may improve, change or remove features; if a change significantly affects what you paid for, we'll let you know.

10. Suspension and account deletion

You can delete your account anytime from Mi Plan. We may suspend or close accounts that violate these terms or the law, notifying you when possible. If we close your account without a violation on your part, we'll refund the unused portion of the period.

11. Liability

To the extent permitted by Colombian law, Skytech Ingeniería S.A.S. is not liable for injuries or damages arising from exercising, misuse of the service or not following the health recommendations in these terms. Nothing in these terms limits your rights under the Consumer Statute.

12. Governing law and claims

These terms are governed by the laws of the Republic of Colombia. If you have a claim, please email [email protected] first so we can find a solution. You may also go to the Superintendence of Industry and Commerce or the competent courts of Cali, Colombia.

13. Changes to these terms

We'll post any changes here with their date. If a change is significant, we'll notify you by email or in the app before it takes effect and ask you to accept it to keep using the service.
